I went to McDonalds on Novelty hill this morning around 5:15 AM on my way to work. I bought a sausage mcMuffin and a sausage burrito. My sausage burrito had a sticker that said I'm loving it holding the paper closed. After eating the burrito, I noticed a sticker beneath that one. It had a use by 10:59 AM from the previous day: 11/2/2009.

An expiration date is only a guideline. If the food is properly handled you can pass the expiration date and the food will still be safe to eat. That is why food banks and day old stores are allowed to distribute the food to the public.

I worked there for 2 years as a teen, and burritos are freshly made every morning and placed in a cooler if any are left over, they are placed in the freezer. Also, rarely there are times when old stickers are placed on new products by accident.

As long as it was kept refrigerated it should be fine. Check out some of the experation dates at the grocery stores. You'd probably be real surprised. Not a law suit issue for sure.
